Penalties for Abuse of this Policy

• Any supplier or potential supplier that deliberately misrepresents the facts in order to gain advantage will be penalised by having its name removed form the SARCC's supplier register

  and

  the names of directors and owners of the enterprise will be recorded and SARCC will reserve the right not to register any new entity of which they are directors, owners or managers, and to preclude them, and their current or new entities, from qualifying for tendering to the SARCC.

• The SARCC may (if any information furnished is found to be false) act against a supplier and :
  • cancel the contract and claim any damages which the SARCC may suffer by having to make less favourable arrangements after such cancellation; and/or
  • impose a penalty not exceeding 5% of the value of the contract; and/or
  • recover all costs, losses or damages incurred or sustained by the SARCC as a result of the contract.
• Fronting is expressly prohibited
